This statement makes even more sense to me today, because the exemption is designed to protect everyone, including those industries themselves, from corruption, such as the kind that emerged with the 1919 Black Sox scandal in baseball, a conflict that required a former US District Court justice and considerable racketeering enforcement to resolve, despite its roots in financial uncertainty that would resolve to be catastrophic (The Great Depression).
The use of certain communication technologies (specifically interactive ai, in the form of mobile devices) leads to unexplainable amounts of corruption, through the use of misleading statements, malicious impersonation, and calls for violence (mostly against mobile service providers and telecommunication/electric infrastructure providers). One needn’t defend why that behavior should be allowed when the organizations fail to enforce protection of other forms of communication that are as basic as the US Constitution’s First Amendment, in the case of social media.
When your anti-trust exemption fails to support enforcement of your organization’s own Constitutional rights to broadcast or publish, specifically the right to edit or rebroadcast without express written consent; when the manner in which it happens leads to perceptions of unfair business practices, this is not a harm you can allow them to inflict upon themselves.
The types of editing and rebroadcast being tolerated are not ‘comment’ and would not be protected speech, in particular when they align with private surveillance. Based on the purpose of Fair Use laws and the principle of comment, they contribute to a sense of dangerous, violent financial failures turning into much more problematic types of violence involving weapons, as in the case of violence outside of stadiums during Dodger/Giants baseball games in the recent past, for example, and the communication tools and strategies being used seem to alter outcomes because they are associated with political goals, even ones as simple as the ubiquity of examples of regional commerce in a mixed economy.
